These Terms of Service (“Terms”) are an agreement between you and Hangzhou Lingshe Kaiwu Technology Co., Ltd. (“LINGSHE”, “we”, “us”). They apply when you access or use our websites, apps, games and other online services (together, the “Services”). Please read them carefully.
Accepting these Terms
By accessing or using the Services, you agree to these Terms and to our Privacy Policy. If you do not agree, please do not use the Services.
Our Services
We are always improving the Services, so we may add, change, suspend or discontinue features at any time. Some Services may have additional terms, which apply together with these Terms. If they conflict, the additional terms prevail for that Service.
Custom development and consulting work for business clients is governed by separate written agreements, not by these Terms.
Eligibility and accounts
You must be old enough to enter into a binding agreement under the laws of your country, or have permission from a parent or legal guardian. If a Service offers accounts, you agree to provide accurate information, keep your login credentials secure and take responsibility for activity under your account. Please tell us promptly if you suspect unauthorized use.
Acceptable use
When using the Services, you agree not to:
- break any law or infringe anyone’s rights, including intellectual property and privacy rights;
- upload or share content that is illegal, harmful, hateful, harassing or misleading;
- interfere with or disrupt the Services, or try to gain unauthorized access to accounts, systems or data;
- use cheats, bots, exploits or unauthorized third-party software, or reverse engineer the Services except where the law allows it;
- use the Services to send spam or for any commercial purpose we have not authorized.
Your content
You keep ownership of the content you create or upload. You grant us a worldwide, non-exclusive, royalty-free licence to host, store, display and process that content only as needed to operate, provide and improve the Services. You are responsible for your content, and we may remove content that violates these Terms or the law.
Purchases and subscriptions
- Purchases made through the App Store, Google Play or other platforms are subject to that platform’s terms and payment rules.
- Subscriptions renew automatically unless you cancel at least 24 hours before the end of the current period. You can manage or cancel a subscription in your platform account settings.
- Refund requests are handled by the platform under its policies, unless applicable law requires otherwise.
- Virtual items and in-game currency have no cash value and cannot be exchanged for money. They are licensed to you, not sold.
Intellectual property
The Services — including software, designs, text, graphics, and the LINGSHE name and logo — are owned by us or our licensors and protected by law. Subject to these Terms, we grant you a personal, limited, non-exclusive, non-transferable and revocable licence to use the Services for your own non-commercial purposes.
Third-party services
The Services may contain links, advertisements or features provided by third parties. We do not control and are not responsible for third-party content or services, and your use of them is subject to their own terms.
Disclaimers
To the extent permitted by law, the Services are provided “as is” and “as available”, without warranties of any kind, whether express or implied, including warranties of merchantability, fitness for a particular purpose and non-infringement. We do not guarantee that the Services will be uninterrupted, error-free or completely secure.
Limitation of liability
To the maximum extent permitted by law, we will not be liable for any indirect, incidental, special, consequential or punitive damages, or for any loss of profits, revenue, data or goodwill, arising from your use of the Services. Our total liability for any claim relating to the Services is limited to the greater of the amount you paid us for the Service in the 12 months before the claim, or USD 100. Nothing in these Terms limits liability that cannot be limited under applicable law.
Suspension and termination
You may stop using the Services at any time. We may suspend or end your access if you violate these Terms, if required by law, or to protect our users or the Services. Provisions that by their nature should survive termination — such as intellectual property, disclaimers and limitation of liability — will survive.
Governing law and disputes
These Terms are governed by the laws of mainland China, without regard to conflict-of-law rules. If a dispute arises, please contact us first so we can try to resolve it informally. If it cannot be resolved, it will be submitted to the competent people’s court in the place where we are registered (Hangzhou). This does not take away any mandatory consumer protection rights you have under the laws of the country where you live.
Changes to these Terms
We may update these Terms from time to time. We will post the updated version on this page and change the “Last updated” date. If the changes are significant, we will provide a more prominent notice. By continuing to use the Services after changes take effect, you accept the updated Terms.
